NativePlants .ai Supplemental Terms / End-User License Agreement

1. Agreement & Relationship to Master Terms

This Supplemental EULA (“Supplemental Terms”) governs your use of the NativePlants .ai mobile application (“App”) and incorporates the Banjo Tech Terms of Service (“Master Terms”). If there is any conflict, these Supplemental Terms control solely for matters specific to the App.

2. License

Subject to your continued compliance with the Master Terms and these Supplemental Terms, Banjo Tech grants you a non-exclusive, non-transferable, revocable, limited license to install and use one copy of the App on an Apple-branded device that you own or control, solely for personal, non-commercial purposes.

3. Apple Minimum EULA Terms

To the extent required by Apple Inc., the "Licensed Application End User License Agreement" (LAEULA) at https://www.apple.com/legal/macapps/stdeula/ is hereby incorporated. Apple is not responsible for (a) the App's operation, (b) maintenance or support, or (c) any claims, losses, liabilities, damages, costs, or expenses regarding the App.

4. User Content in the App

By uploading photos or other content, you grant Banjo Tech the perpetual, worldwide, sublicensable license described in §5 of the Master Terms. Do not upload images you do not own or that infringe others' rights.

5. AI-Generated Outputs

Landscaping previews generated by the App are for informational and illustrative purposes only. Actual plant compatibility and local regulations may differ. Consult a qualified landscape professional before undertaking any work.

6. Subscriptions & In-App Purchases

Subscriptions purchased via Apple App Store renew automatically unless canceled at least 24 hours before the end of the current period. Billing, refunds, and cancellation are handled by Apple, not Banjo Tech.

7. Disclaimers & Liability

ALL DISCLAIMERS, LIMITATIONS OF LIABILITY, AND INDEMNITIES IN THE MASTER TERMS APPLY FULLY TO THE APP AND ITS OUTPUTS. WITHOUT LIMITING THE FOREGOING, BANJO TECH DISCLAIMs ALL WARRANTIES THAT THE APP'S AI DESIGNS ARE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SPECIFIC LOCATION OR CONDITIONS.

8. Governing Law, Dispute Resolution

The Governing-Law, Arbitration, and Class-Action-Waiver provisions in the Master Terms (§15) apply to your use of the App.

9. Modifications

Banjo Tech may amend these Supplemental Terms by posting an updated version at the URL above and providing in-app notice at least 14 days before the effective date. Continued use after that date constitutes acceptance.
